| Sarin Technologies has acted to halt unsubstantiated rumors circulating in India that it has lost a patents rights suit that it brought against OGI in Belgium. Noting that the suit against OGI is proceeding satisfactorily, the company said: “We have not been deterred in the past and will not refrain in the future from swift action against those who choose to infringe on our patent, trademark, and copyright assets in any country in which they are protected or against those who choose to disrespect our rightfully owned intellectual property rights.” Several months ago Sarin notified the international diamond sector that it had been granted a “descriptive seizure order”, which prohibits, among others, ``OGI from selling … any of its products which are allegedly infringing Sarin`s patent or from parting with these in any other way…,” in ex parte patent-infringement proceedings which Sarin had instituted against OGI Systems Europe in Belgium. On August 27, 2005, a designated expert appointed by the Belgian Court to evaluate the facts pertaining to the alleged infringement by OGI’s machines of Sarin’s patent for the purpose of the descriptive seizure proceedings, issued his final report, which was, as expected, favorable to Sarin. This has strengthened Sarin`s assertion that OGI`s machines, in respect of which Sarin had instituted proceedings in Belgium, infringe on patents owned by Sarin. While the favorable report does not constitute the final step in the legal process, it is considered another important step in Sarin`s continued effort to enforce its rightful patent rights in Belgium and worldwide. Consequently, on September 27, 2005, Sarin filed a writ of summons against both OGI Systems Europe and OGI Systems Ltd. in the Antwerp Court of First Instance in Belgium, for infringement of its patent. In the interim period, while the suit is being prosecuted, the Belgian Court seizure order, as described above, remains in force. |
